The Timbers Subdivision was first deeded as "Section B, Rubert Manor" on November 25, 1970. It was renamed "The Timbers" as per Plat 42, page 10 dated April 01, 1971.
​
The Timbers subdivision consists of 47 homes shown on Plat 42 page 10. Also shown on the subdivision Plat is the "Recreation Area" (see plat).
​
The Recreation Area was deeded from the Grantors (Bertram Moore, Julia Moore and Anna May Bunker, using Anne Arundel County as the trustee to be used for recreation by the subdivision's, then unnamed civic association.
​
The Timbers Civic Association Inc. was incorporated in March 27, 1972.
​
The Recreation Area was deeded from Anne Arundel County (Trustee) to the Timbers Civic Association June 20, 1972.

Please note the clause taken from the Recreation Area Deed:​
​
​" In the event that the Timbers Civic Association, Inc. cease to be ​a *legal entity, or the property herein described shall be used for purposes other than recreation area for the benefit of the lot owners in the Timbers subdivision, then the property shall revert to and become the property of the GRANTOR herein, in fee simple​."​​​​​​​​​​​​

​* legal entity means we maintain our corporate standing by maintaining:

Articles of Incorporation;

Bylaws;
-
Minutes from Meetings of the Executive Board and
-
filing a Form 1 by 15 April each year to Anne Arundel County government.

Conversely, the deed's clause, also means that all lot owners (houses 1–47) of the Timbers subdivision share equally in the responsibility to keep the Timbers Civic Association, Inc. a legal entity. Should the Timbers Civic Association, Inc. dissolve (either through bankruptcy or via failure to keep the insurance and required incorporation documents current), the Recreation Area property will revert back to the Grantors, Bertram and Julia Moore and Anna Bunker (or their heirs).

The Timbers Civic Association, Inc at a bare minimum to remain a legal entity, must:

maintain the recreation area to a reasonably safe standard;

pay its electrical bill for lighting at the park;

carry sufficient liability insurance coverage;

have a full Executive Board (consisting of a President, Secretary and Treasurer);

hold quarterly Executive Board meetings and post minutes from all Exective Board meetings,
-
hold an annual audit of its finances;

maintain a set of bylaws,
-
Hold two semiannual meeting of members - March and October,
-
file an annual Form 1 with the Maryland Department of Taxation and Assessments.

Ownership of the Rec Area and Association Membership Eligibility

The Timbers Civic Association owns the Recreation Area – not the individual property owners of homes 1–47 who live in the Timbers Subdivision

Deed caveat means that the Association CANNOT EXCLUDE any of the homes 1–47 in the Timbers from becoming members.

All Property owners of homes 1–47 must be invited to join the Timbers Civic Association each year.

It is their choice whether or not to join.

Deed caveat DOES NOT MEAN that the Association is exclusive (or only) to homes 1-47.

Our membership can include other homes outside the Timbers, but this change would require majority vote of approval from the current Members -In-Good-Standing AND an amendment to our Bylaws.

OUR COMMUNITY
​Timbers Civic Association, Inc.
​
In January 1970, the Recreation Area within the Timbers Subdivision was deeded to a then, unnamed Civic Association. The deed to Recreation Area listed the grantors to be: Bertram Moore, Julia Moore and Anna May Bunker (the original owners of the land). Anne Arundel County served as the interim trustee for the Recreation Area, Up until a Civic Association could be established by the home owners (lots 1-47) within the Timbers Subdivision.

In 1972, Timbers Civic Association, Inc. was created and Articles of Incorporation were filed with the Maryland Department of Taxation and Assessments to indicate it was formed as a CIVIC Association.

The Timbers Civic Association, Inc. is a non-stock corporation. It was created to provide the lot owners of the Timbers Subdivision a way to share in the mutual benefit of, and in the shared burden of responsibility for all maintenance, upkeep and annual liability insurance coverage for the Timbers Recreation Area.

The Timbers Civic Association, Inc is NOT a Home Owners Association (HOA) as per the Maryland Homeowners Association Act.
(The Maryland Homeowners Association Act applies only to associations created after 1987 and only to those who were originally formed as homeowners associations (HOAs) as per their charter. As further proof HOA legal status, these homeowners associations must have their HOA covenants filed with Anne Arundel County. A list of HOAs in Anne Arundel County and their covenants can in the be found in the Homeowners Associations Book located in the division of land records in the basement of the Anne Arudel County courthouse.)
The Timbers Civic Association, Inc. DOES NOT have covenants, nor is it identified as an HOA according to Anne Arundel County records and according to its charter (Articles of Incorporation).

Since the Timbers Civic Association, Inc was incorporated in 1972, it is a non-stock corporation, governed by the Maryland Corporation Law and a set of BYLAWS (internal rules that govern the organization). Bylaws are internal to the Timbers Civic Association, Inc organization.

The BYLAWS were first written and established in 1974. These Bylaws were rewritten, voted on and approved in May 2013 (see current Bylaws) . Amendments to the BYLAWS have been written over the years and approved by a majority (55%) vote of the members in good standing of the Timbers Civic Association Inc.

Membership:
All property owners of the Timbers Subdivision are eligible for membership in the Timber Civics Association Inc. ​​​​Membership in the Civic Association is renewed each year when a household voluntary pays the annual dues set forth in the bylaws. Members in good standing are permitted to use the recreation area, participate in Timbers Civic Association, Inc governance, serve on committees which direct how the dues will be used for that year, and vote on amendments to the BYLAWS governing the Timbers Civic Association, Inc. ​

Dues are $100 per household per year and are used to fund yearly operating costs; primarily the annual liability insurance coverage, lighting at the Recreation area and maintenance costs for upkeep of the Recreation area.

As per the BYLAWS, members who decline to paid their dues in full, forfeit their voting privileges within the association for that year.
