Articles of Incorporation

As per the Timbers Subdivision Plat  (see small print in text boxes of plat)  the Recreation Area, was to be deeded to a "Civic Association".  This document is the original Articles of Incorporation bringing the Timbers Civic Association, Inc into being. The Timbers Civic Association, Inc. was incorporated in 1972.

                “In the event that the Timbers Civic Association, Inc  cease to be a legal entity, or the property herein described shall be used for purposes other than a recreation area for the benefit of the lot owners of the Timbers Subdivision, then the property shall revert to and become the property of the GRANTOR herein, in fee simple.”

Revival

As stated in this document, the Timbers Civic Association, Inc. forfeited its original charter in Dec 1976 (due to failure to file required annual reports and payment of taxes).  The Association was dissolved and ceased to be a legal entity for three years.  During this time, the "ownership" of the Recreation Area as per the Recreation Area Deed caveat, was in legal  limbo.  The Rec Area could have legally reverted back to the original GRANTORS if they chose to press their legal advantage.  

       Thankfully, The Timbers Civic Association, Inc. was revived in 1979 as a corporation in good standing, to keep ownership of the Recreation Area. 

      Open space in Anne Arundel County is a gift that should not be taken for granted.  This anecdotal story shows what the members of the Timbers Civic Assoc stand to lose should its members become benignly complacent and not fully understand our legal responsibilities.

Timbers Subdivision Deed and Subdivision Covenants

*note important distinction:

Timbers Civic Association, Inc does NOT have covenants

This document is the original deed for the Timbers Subdivision.  This document contains the county covenants, that existed in 1970 which were required to be filed with the subdivision deed before the Subdivision could be built.  These covenants were intended to govern each future lot owner who bought a lot in the Timbers Subdivision.  

     ONLY County Officials can enforce these covenants.  The Timbers Civic Association, Inc was incorporated two years later in 1972 to take ownership  of the Recreation Area NOT the Subdivision.  The Officers of the Timbers Civic Association CANNOT enforce these covenants nor get involved in property disputes between homeowners in the Timbers Subdivision. 

      Covenants DO NOT expire, however they can be changed to mirror revised land covenants.  Note: paragraph 13 TERMS:

“13. TERMS.   These covenants are to run with the land and shall be binding on all parties and all persons claiming under them for a period of thirty years from the date these covenants are recorded after which time said covenants shall be automatically extended for successive periods of 10 years unless an instrument signed by a majority of the owners of the lots has been recorded agreeing to change said covenants in whole or in part.” 

       These are NOT Homeowners Association covenants.

The Timbers Civic Association, Inc is NOT a homeowners association because it was never formed to be a homeowners association.  The Civic Association does NOT  have covenants nor does it have enforcement authority for these covenants !
